These General Terms and Conditions apply to all package travel contracts concluded between the customer and SkyAlps Holidays srl (hereinafter "Organiser"). They supplement and give effect to the statutory provisions of Articles 32 et seq. of the Italian Tourism Code (D.Lgs. 23 May 2011, No. 79) and the mandatory consumer protection provisions of the customer's country of residence.
1. Scope and Conclusion of Contract
1.1 These conditions apply exclusively to flight package tours (flight + hotel + transfer) offered by SkyAlps Holidays srl, headquartered in Bolzano, Italy.
1.2 By making a booking (registration), the customer makes a binding offer to conclude a package travel contract. The booking may be made in writing, electronically, by telephone or via online services and is also binding for all fellow travellers listed in the registration, for whose contractual obligations the registrant is responsible as for their own.
1.3 The contract is concluded upon receipt of the travel confirmation/invoice in text form (print or PDF) by the registrant. If the content of the confirmation differs from the registration, this constitutes a new offer by the Organiser, binding for ten days. The contract is concluded on the basis of this new offer if the customer expressly accepts it or makes a deposit within this period.
1.4 Travel agents and third parties are not authorised to issue confirmations on behalf of the Organiser or to make collateral agreements.
1.5 Together with the travel confirmation, the customer receives the legally required security certificate or equivalent confirmation protecting customer funds against insolvency of the Organiser.
2. Payment
2.1 Upon receipt of the travel confirmation and security certificate, a deposit of 20% of the travel price – plus any insurance premiums – is immediately due.
2.2 The remaining balance is due without further request no later than 30 days before the start of travel, provided the travel can no longer be cancelled for reasons attributable to the customer.
2.3 For late bookings (less than 30 days before the start of travel), the full travel price is immediately due in one lump sum.
2.4 If the customer is in default of payment and fails to pay despite a reminder and reasonable grace period, the Organiser is entitled to withdraw from the contract and claim compensation pursuant to Clause 5.
2.5 Payments with debt-discharging effect may only be made to the Organiser, unless otherwise stipulated in the travel confirmation. The Organiser reserves the right to make acceptance of a booking conditional on payment by credit card.
3. Services and Collateral Agreements
3.1 The scope of the contractual services is set out in the service description valid at the time of booking (catalogue, online portal, offer) and the information in the travel confirmation. Service descriptions by third parties (e.g. hotels) are not binding on the Organiser unless expressly incorporated.
3.2 Special agreements and collateral agreements that change the scope of the contractual services require express confirmation in text form by the Organiser.
3.3 For age-related discounts, the date of commencement of travel is decisive. Costs arising from incorrect information provided by the customer shall be borne by the customer.
3.4 In low and shoulder seasons, certain hotel facilities or outdoor pools may not be available or may only be partially available.
4. Price and Service Changes after Conclusion of Contract
4.1 The Organiser reserves the right to increase the agreed travel price after conclusion of the contract if transportation costs, charges for certain services or applicable exchange rates increase and this directly impacts the travel price.
4.2 A price increase is only permissible if more than four months elapse between conclusion of the contract and the agreed start of travel, and the circumstances were not foreseeable. A price increase from the 21st day before the start of travel is not permitted.
4.3 In the event of a price increase of more than 8%, the customer is entitled to withdraw free of charge or to request participation in an at least equivalent alternative trip.
4.4 The Organiser is entitled to change individual travel services after conclusion of the contract, provided the change is not significant. The customer shall be notified immediately on a durable medium of any significant change.
5. Withdrawal by the Customer, Cancellation Fees
5.1 The customer may withdraw from the contract at any time before the start of travel. It is recommended to declare withdrawal in text form, stating the booking number.
5.2 If the customer withdraws from the contract or fails to commence the trip, compensation is calculated on a lump-sum basis as follows:
Time of withdrawal (before departure) – cancellation fee (% of travel price):
- Up to 31 days before departure – 20%
- From the 30th day before departure – 50%
- From the 24th day before departure – 60%
- From the 14th day before departure – 95%
- Day of departure, no-show or early termination of trip – 100%
5.3 The customer reserves the right to prove that the Organiser has suffered no loss or a significantly lesser loss than the applicable lump-sum compensation.
5.4 The Organiser reserves the right to claim a specifically calculated higher compensation instead of the lump-sum.
5.5 In the event of unavoidable, extraordinary circumstances (force majeure, natural disaster, epidemics, etc.) at or near the destination, the customer may withdraw without payment of compensation. Payments already made will be fully refunded within 14 days.
5.6 The conclusion of travel cancellation insurance and repatriation cost insurance is expressly recommended.
6. Rebooking, Substitute Person, Deposit of Documents
6.1 The customer has no legal right to rebooking after conclusion of the contract. Where rebooking is possible, a processing fee of €50.00 per person plus any additional costs from service providers will apply.
6.2 Up to the start of the trip, the customer may request that a third party assume the rights and obligations under the travel contract. Processing fee: €30.00 per person.
6.3 If documents cannot be posted in time, the Organiser may arrange for tickets or other documents to be deposited at selected airports. Processing fee: €15.00 per transaction.
6.4 In the cases referred to in Clauses 6.1 to 6.3, the customer reserves the right to prove that the Organiser has incurred no or significantly lower costs.
7. Withdrawal by the Organiser
7.1 The Organiser may withdraw from the travel contract up to 20 days before the start of travel if the minimum number of participants is not reached. The travel price will be refunded within 14 days.
7.2 In the event of unavoidable, extraordinary circumstances, the Organiser may withdraw before the start of travel. All payments will be fully refunded within 14 days. Any claim for damages is excluded.
7.3 The Organiser may terminate the contract without notice if the customer persistently disrupts the trip or behaves contrary to the contract.
8. Customer's Obligations to Cooperate, Notification of Defects, Remedy
8.1 The customer must check the details in the travel confirmation immediately upon receipt for accuracy and report any discrepancies without delay.
8.2 Travel documents must be checked for completeness. If documents are not received by no later than 7 days before departure, the customer must contact the Organiser without delay.
8.3 The customer must arrive at the airport at least 2 hours before the scheduled departure. Return flight times must be confirmed 24–48 hours before the scheduled return.
8.4 The customer ensures they are regularly reachable at the contact details provided at booking, especially in the last 3 days before travel.
8.5 Defects must be reported without delay to the local tour guide or directly to the Organiser. Notification to the service provider is generally not sufficient.
8.6 If the customer culpably fails to report a defect, claims for reduction or damages may lapse.
8.7 If luggage is lost or damaged in connection with a flight, a P.I.R. must be filed immediately on site with the operating airline.
8.8 The customer is obliged to do everything reasonably possible to remedy any service disruption and minimise any damage.
9. Limitation of Liability
9.1 The Organiser's contractual liability for damages that are not personal injuries is limited to three times the travel price, provided damage was caused neither intentionally nor through gross negligence.
9.2 For tort claims not based on intent or gross negligence, the Organiser's liability for property damage is limited to three times the travel price.
9.3 The Organiser is not liable for service disruptions in connection with services arranged as pure third-party services expressly identified as such in the travel prospectus.
10. Notes on Liability in International Air Transport
10.1 The liability of operating airlines is governed by the Warsaw Convention, the Montreal Convention and EU Regulations, in particular Regulation (EC) No. 261/2004 and Regulation (EC) No. 889/2002.
10.2 The Organiser will inform the customer of the identity of the operating airline before conclusion of the contract and of any subsequent changes without delay.
11. Travel Insurance
11.1 Unless otherwise expressly stated, travel cancellation insurance is already included in the travel prices. Additional insurance is recommended.
11.2 Insurance contracts are concluded exclusively between the customer and the insurance company. Cover commences at the earliest upon full payment of the insurance premium.
12. Passport, Visa and Health Regulations
12.1 Before conclusion of the contract, the Organiser informs EU citizens about the general passport, visa and health regulations of the destination country.
12.2 The customer is solely responsible for compliance with all regulations and for carrying the necessary travel documents.
13. Data Protection and Prohibition of Assignment
13.1 The customer's personal data is processed electronically by the Organiser for contract performance in accordance with the GDPR and Italian data protection law. See www.skyalps-holidays.com/privacy.
13.2 The assignment of warranty or damage claims and the judicial enforcement of claims of other travellers in one's own name are excluded.
14. Jurisdiction and Applicable Law
14.1 The contractual relationship is governed exclusively by Italian law, taking into account the mandatory consumer protection provisions of the customer's country of residence.
14.2 The place of jurisdiction for claims by the customer against the Organiser is Bolzano, Italy.
14.3 The EU Commission provides an ODR platform at ec.europa.eu/consumers/odr. The Organiser is neither obliged nor willing to participate in dispute resolution proceedings.
15. Final Provisions
15.1 Should any individual provisions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.
15.2 Amendments or additions to these GTC must be made in text form.
